These Terms of Service ("Terms") govern your use of the website and services operated by Touchpoint AI ("we," "us," or "our"), accessible at https://www.touchpointai.co. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

Touchpoint AI provides custom website design and development for small and mid-sized businesses, along with ongoing hosting, maintenance, and support. Services are delivered directly by the founder: one point of contact throughout, no account managers.

The specific scope, deliverables, timeline, and pricing for any engagement are defined in a separate written service agreement provided to each client before work begins. These Terms govern your general use of our website and services; the service agreement governs the specifics of your project.
Free previews: if you ask for a free preview, we make a sample homepage using your business name and details, including information and photos you have shared publicly or sent us. It is free and you owe nothing. Until you sign up for a plan, the preview stays our work, so please don't copy or publish it. We take previews down after about two weeks, or sooner if you ask.
Design services: logos, brand kits, flyers, menus, price sheets, review cards and custom graphics can be included in a website plan or bought on their own. For social media, we design profile and cover images that you upload yourself; we don't run, post to or manage your social media accounts. Design work bought on its own is paid in full before work starts and includes one round of changes. We deliver digital, print-ready files; printing is up to you and paid by you. Once paid, you own the final files and all rights we have in them. We use design tools, including AI, so we can't promise that a design can be registered for copyright or trademark, and we only do a basic check that a design doesn't copy another brand. We won't use logos, characters or artwork you don't have the rights to. You confirm you have the rights to anything you send us to use in a design, and you're responsible for how you use the final designs.
We accept major credit and debit cards and other payment methods offered at Stripe checkout. All payments are processed in US dollars (USD).
Payment terms for each engagement are outlined in the service agreement. Website plans consist of a one-time setup fee, due before work begins, and a monthly plan fee billed in advance. Card payments are processed by Stripe.
You agree to provide current, complete, and accurate payment information. We reserve the right to refuse or cancel any order if we suspect fraud or unauthorized activity.
Each website is provided on a plan that covers ongoing hosting, maintenance, and support. Plans are billed monthly and renew automatically each month until you cancel. There is no minimum term and no cancellation fee.
By subscribing to a plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel. You will be notified of any change to plan pricing at least 30 days in advance, and you may cancel before the new price takes effect.
A monthly plan generally includes hosting, bug fixes, small updates (published on a set schedule, depending on your plan), a monthly check-in, and direct access to the person who built your site. Larger additions and new features are quoted separately. The exact inclusions and price for your plan are set out in your service agreement.
You can cancel any time by emailing contact@touchpointai.co. Your plan stays active until the end of the month you've already paid for, then it ends. You won't be charged again, and the month already paid for isn't refunded. For example, if you cancel on the 15th, your website stays up through the end of that month, unless you ask us to hand it over sooner.
Handover: when your plan ends, or sooner if you ask, we send you everything that's yours: your website files, your logo and design files, and any logins we hold for your domain, email or Google profile. We help point your domain to your new host within 10 business days, and then hosting on our accounts stops. We keep a backup for 30 days after hosting ends, then delete it, so please keep your copy. Your website, data and content are always yours.
We may pause or end services for non-payment or a violation of these Terms, as described in your service agreement.
All fees are non-refundable, except in the cases listed below. This includes the setup fee, which pays for reserving time in our schedule and starting your build right away, and plan fees already charged for the current month. Nothing more is charged after you cancel.

Any content, data, and materials you provide to us remain yours at all times.
You own the website we build for you, including its design and content, from day one. Any additional terms are defined in your individual service agreement, which controls in all cases.
Third-party tools, platforms, and infrastructure used to build or run your project (for example hosting, domain, email, and Google services) remain subject to their own terms of service and ownership policies. Where you maintain your own accounts for these services, you own those accounts and the data within them.
The Touchpoint AI name, logo, and website content are our property and may not be used without permission.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.
We make no guarantees regarding specific business outcomes attributable to the websites or services we provide. Results depend on many factors outside our control, including how the website is used and the nature of your business.
We are not responsible for failures, downtime, data loss, or other issues caused by third-party platforms and infrastructure (such as hosting, domain, email, or Google services) outside our reasonable control. We will use reasonable efforts to maintain and support websites covered by an active monthly plan.
To the fullest extent permitted by law, Touchpoint AI's total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount you paid us in the twelve (12) months preceding the claim.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, even if we have been advised of the possibility of such damages.
Any claim you bring against us must be brought within one (1) year of the date the claim arose. Claims brought after this period are permanently barred.
Before initiating any formal proceeding, you agree to first contact us at contact@touchpointai.co and give us 30 days to attempt to resolve the dispute informally. Most concerns can be resolved this way.
If informal negotiation does not resolve the dispute, either party may bring it in the courts of Maricopa County, Arizona, including small claims court where the amount allows.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles. Both parties consent to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be posted on this page with the revised effective date. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. If you are a client, the Terms in effect on the date of your service agreement apply to it, unless we both agree in writing to newer ones.
